Our services are provided through the websites as above (which include mobile applications), is a telemedicine online solution that allows medical professionals and health care staff (healthcare providers or providers) to connect with their clients (patients) virtually, providing them quality clinical care and perform virtual real time consultations via a secure internet connection (the services).

The services are intended for use by health care providers and patients in connection with active patient monitoring so as to allow immediate clinical action or continuous monitoring by a health care provider or the patient.

To the extent medical advice is provided to you by a health care provider through the services, such medical advice is based on your personal health data as provided by you to the health care provider and the local standards of care for your presenting symptoms, based on the information you provide. The medical advice provided by your healthcare provider is not under the control of EFU mHealth, nor is it provided to or used by EFU mHealth, the company.

All your protected health information maintained by EFU mHealth, including information you provide on the App, is also subject to Privacy Rule under the Health Insurance Portability and Accountability Act ('HIPAA').

EFU mHealth is committed to protecting the privacy of the users of the EFU mHealth App and will use and disclose your personal information as stated in this Privacy Statement. By using this telemedicine service, you agree to the collection and use of information in accordance with this policy. Unless otherwise defined in this Privacy Policy, the terms used in this Privacy Policy have the same meanings as in our Terms and Conditions.

Use and disclosure of health information includes, using the information to provide management and prevention guidance to the individual with chronic disease, and to conduct data analytics to improve the telemedicine experience. Our use and disclosure of an individual's personal information (including health information) is limited as required by state law. We do not sell or rent personal information about visitors to the EFU mHealth App.

The EFU mHealth App has security measures in place that are intended to help protect against the loss, misuse, unauthorized access or alteration of information under our control. These measures include encryption of data during transmission using the Secure Socket Layer (SSL) system, encryption of data at rest, using a secured messaging service, and a secured transfer of data to the App. Despite these measures, the confidentiality of any communication or material transmitted to or from us via the EFU mHealth App by Internet, text message, or email cannot be guaranteed. At your discretion, you may contact us at the mailing address or telephone number listed in the "Contacts" section at the end of this Privacy Statement.

In our recent update, we have introduced an additional tab for user data in our application. This tab allows users to view and manage the data collected during the sign-up process. We understand the importance of user privacy and are committed to providing transparency and control over their personal information.

  1. Navigate to the "Profile" screen from the bottom menu of our application
  2. Click on "Settings" to access account options
  3. Locate and select the "Delete Account" option
  4. A confirmation popup will appear
  5. Confirm the deletion by following the on-screen prompts

Option 2: Assisted Deletion

If you encounter any difficulties with the self-service option, you can contact our 24/7 helpline at 042-111-333-033 and request account deletion. Our authorized personnel will process your request through our secure super-admin portal.

The EFU mHealth Video Section is named as a mHealth show which is recorded on EFU mHealth Studio by our media team and published on YouTube. After publishing on YouTube, the videos are linked to the EFU mHealth Application. We do not collect any customer videos on our application. However, we may collect certain information from our users, including their name, email address, location, IP address, device information, and any other information that they voluntarily provide to us. All Videos are linked via gofit.efumhealth.com.pk.

EFU mHealth Application offers a video consultation service for patients to consult with mHealths remotely. The video calling service is facilitated by a third-party provider, Agora SDK. It is important to note that all video calls conducted through the EFU mHealth Application are not recorded in any way. This is to ensure the privacy and security of patients and their personal information. EFU mHealth Application ensures that no one, including its staff or any unauthorized individuals, can access or view the video consultation. This provides patients with a safe and secure environment to discuss their health concerns with their mHealths without any fear of their information being compromised. Overall, EFU mHealth Application prioritizes patient privacy and security in all aspects of its services, including its video consultation feature.

Community EFU Pvt. Ltd. (privately registered name) is, unless otherwise stated, the owner of all the copyright, trademark, patent, trade secret, database and other proprietary rights to the information including without limitation, the EFU mHealth App. Without limitation of the foregoing, we assert ownership of a copyright in the entire system, including without limitation, the EFU mHealth App, as a collective work and/or compilation, and in the selection, coordination and arrangement of the information and content in the EFU mHealth App.

In addition to web logs, described below, EFU mHealth routinely gathers data from the App activity, such as how many people visit the site, the web pages or mobile screens they visit, what workflow they follow, how long they stay on each page, the exchange of messages between the users etc. The data is collected on an aggregate, anonymous basis, which means that no information is personally identifiable or is associated with the data. This data collected helps EFU mHealth to improve content and overall usage. The information is not shared with any other organizations for their independent use.

The EFU mHealth App does not honour a browser's signal or header request to track the user's activity.

As disclosed in this Privacy Statement, we do not collect any personally identifiable information about users to the EFU mHealth Apps.

EFU mHealth uses server information to improve the design of EFU mHealth Apps; to identify popular features; to resolve user, hardware, and software problems; to make the EFU mHealth Apps more useful to users for security purposes.

When you access Service with a mobile device, this Usage Data may include information such as the type of mobile device you use, your mobile device unique ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browser you use, unique device identifiers and other diagnostic data.

The law does not, however, require us to restrict any disclosures we think are important for treatment purposes.

We will retain your information for as long as your account is active or as needed to provide you services. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. We will retain your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies. We will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period, except when this data is used to strengthen the security or to improve the functionality of our Service, or we are legally obligated to retain this data for longer time periods.

The security of your data is important to us but remember that no method of transmission over the Internet or method of electronic storage is 100% secure, encrypted on Microsoft Azure, a leading cloud service. However, while we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee its absolute security if you were to risk the information at your own end by providing access to users others than yourself.

We may employ third party companies and individuals to facilitate our Service (Service Providers), provide Service on our behalf, perform Service-related services or assist us in analysing how our Service is used. These third parties have access to your Personal Data only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.

Payment Gateway

We have partnered with third-party payment vendors SIMPAISA and NEEM and integrated their gateways. These third parties are solely responsible for any use or misuse of data that is limited to the gateway or miscellaneous funds related operational concerns regarding the gateway and its functionality.

9. Payments

By registering for an account with EFU mHealth, you become a registered user with access to certain password-restricted areas of the site and to use certain services and materials offered on and through the site (a subscription). Each subscription and the rights and privileges provided to a registered user is personal and non-transferable. All sales and payments of subscription fees will be in Pakistani Rupee (PKR). All subscription fees are non-refundable under any circumstances.

EFU mHealth reserves the right to change prices for subscriptions at any time, and does not provide price protection or refunds in the event of promotions or price decreases. Notwithstanding the foregoing, EFU mHealth shall notify registered users of any price changes thirty (30) days prior to any change. EFU mHealth shall honor any subscription prices until the expiration of the applicable subscription term.

The Services will be provided against pre-payment by patient, without any right of set-off, deduction or counterclaim, to the extent, and for as long as, Customer is in credit. Customer will pre-pay the Services using the options provided via the third-party payment gateways integrated in the App, including SIMPAISA and NEEM.

10. Links to Other Sites

Our Service may contain links to other sites that are not operated by us. If you click a third-party link, you will be directed to that third party's site. We strongly advise you to review the Privacy Policy of every site you visit. We have no control over and assume no responsibility for the content, privacy policies or practices of any third-party sites or services.

11. Children's Privacy

Our Services are not intended for use by children under the age of 18 (Child or Children) without the presence of a guardian. We do not knowingly collect personally identifiable information from Children under 18. The physician is instructed to report any account created by a Child where he/she has provided us with Personal Data, to us. If we become aware, directly, that we have collected Personal Data from Children without verification of parental consent, we take steps to remove that information from our servers.

12. Accessing or Modifying Your Account Information

You can use the EFU mHealth App and self-register to create a new account. Your Login Credentials. You are responsible for maintaining the confidentiality of your login credentials and are fully responsible for all activities that occur with your credentials. You agree to notify EFU mHealth immediately if you believe the confidentiality of your login credentials has been compromised or if you suspect unauthorized use of your account. You agree that we will not be liable for any loss or damage arising from unauthorized use of your credentials.

13. Location-Based Services

Some of the features of the EFU mHealth App may access your location in order to personalize your experience with the App based on your location ('Location-Based Services'). These services specifically include facilitating medicine delivery and lab home sampling services to your location. In order to use certain Location-Based Services, specific features of your mobile phone must be enabled, such as GPS, Wi-Fi, and Bluetooth, which enable EFU mHealth App to identify your location through a variety of means, including GPS location, IP address, cell tower location, geo-fencing technology, or detection by physical on-location Wi-Fi, as available. By enabling Location-Based Services on your device, you agree and acknowledge that (a) device data EFU mHealth App collects from you is directly relevant to your use of the App, (b) EFU mHealth App may provide Location-Based Services related to and based on your then-current location, and (c) EFU mHealth App may use any information collected in connection with the provision of Location-Based Services in connection with its provision of the App.

14. Communications - Consent to Receive Email/Phone Communications

You agree to receive alerts in the form of emails, SMS and phone calls from EFU mHealth at the contact details i.e. email address & contact number you provided to us during sign up. These alerts include customer service-related and promotional purposes and in connection with providing communications that are features of the EFU mHealth App (e.g., information on new products or features, informational notifications, and motivational alerts). You agree to receiving such alerts during the active period of your account. In connection with your use of the EFU mHealth App, you understand and acknowledge the following:

The contents of the EFU mHealth App include designs, text, graphics, images, video, information, logos, button icons, software, audio files, computer code, and educational information. All content and the compilation (meaning the collection, arrangement, and assembly) of each component is the property of EFU mHealth and is protected under copyright, trademark, and other laws.

16. Intellectual Property Rights and Our License to Use

The EFU mHealth App may include features that enable you to post certain materials from your device to the App. Except for telemedicine services provided to you on or through the App, you agree that you, solely, are responsible for, and assume all liability and consequences regarding the photos, video, audiovisual, audio, text, and any other media content that you post to or through the EFU mHealth App along with all associated metadata (which may include, without limitation, your device type, Applicable device identifier, IP address, phone state, as well as date, time, and Application and location data associated with Internet and data services and the creation or submission or a particular piece of content) (collectively 'Your User Content').

You Acquire No Ownership of Others' Content. You understand and agree that you will not obtain, through use of the EFU mHealth App, any right, title, or interest (including intellectual property rights) in content delivered via the App. Consent to Use of Data.

You agree that EFU mHealth may collect and use technical data and related information, including, but not limited to, unique device identifiers and other technical information about your device, system and Application software, and peripherals that is gathered periodically to facilitate the provision of software updates, product support, and other services to you (if any) related to the EFU mHealth App, and to track and report your activity inside of the App, including for analytics purposes.

17. Intellectual Property Policy

EFU mHealth respects the intellectual property of others and takes the protection of copyrights and all other intellectual property very seriously, and we ask our users to do the same. Infringing activity will not be tolerated on or through the EFU mHealth App. EFU mHealth's intellectual property policy is to (a) remove material that it believes in good faith, upon notice from an intellectual property owner or their agent, is infringing the intellectual property of a third party by being made available through the EFU mHealth App, and (b) remove any User Content posted to the EFU mHealth App by 'repeat infringers'. EFU mHealth considers a 'repeat infringer' to be any user that has posted User Content to the EFU mHealth App and for whom EFU mHealth has received more than two takedown notices compliant with respect to that User Content.

EFU mHealth has discretion, however, to terminate the account of any User after receipt of a single notification of claimed infringement or upon its own determination.

18. Consequences of Violating the privacy policy

We reserve the right to suspend or terminate your account and prevent access to the EFU mHealth App for any reason, including if you engage in activity that, in the organisation's sole judgment, violates this privacy policy, without notice and at our discretion. We reserve the right to refuse to provide services on the EFU mHealth App or any portion thereof to you in the future. We may block or prevent your future access to and use of the EFU mHealth App or any portion thereof.

We are authorized to review and remove any User Content at any time for any reason, including if you engage in activity which, in EFU mHealth's sole judgment: violates this privacy policy; violates Applicable laws, rules, or regulations; is abusive, disruptive, offensive, or illegal; or violates the rights of, or harms or threatens the safety of, users of the EFU mHealth App. You are responsible for any claims, fees, fines, penalties, and other liability incurred by us or others caused by or arising out of your breach of this privacy policy and your use of the EFU mHealth App. You are solely responsible for maintaining backup copies of any User Content you post to the EFU mHealth App.

19. For mHealths or Medical Professionals

If you are a mHealth or medical professional registering on this App, by enrolling in or using this service, you hereby confirm that usage is at your own risk and you release and agree to hold harmless the providers, developers, deployers from liability for adverse consequences, including but not limited to claims, actions or legal proceedings by third parties, loss or breach of any private data and/or damages suffered as a result thereof.

20. Indemnification

You agree to defend, indemnify and hold harmless EFU mHealth, its telemedicine platform, its medical practitioners, its affiliates, licensors and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these privacy policy for your use of the App, including, but not limited to, Your User Content, any use of the App's / App's content, services and products other than as expressly authorized in these privacy policy for your use of any information obtained from the App.
